This Privacy Policy explains Artkwaba’s online and offline information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can opt out of, correct, or change such information.
By using or accessing Artkwaba’s Services in any manner, you acknowledge that you accept the practices and policies outlined in our Privacy Policy, and you hereby consent that we will collect, use and share your information as detailed below. If you are a resident of U.S, North America, APAC, you may have additional rights with respect to your personal information as outlined below.
Your use of Artkwaba’s Services is governed by our Terms, which incorporates this Privacy Policy. Terms used in this Policy without definition use the definitions given in the Terms. Scope
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.artkwaba.com (the “Site”). This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Site. “Personal Information” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules, or regulations. This Policy applies only to Personal Data collected directly from you; if we did not collect data directly from you, you should contact the entity that collected your Personal Data in the first instance to address your rights with respect to this data.
We gather various types of Personal Information from our users, as detailed below. This information is used in connection with our services including to contact you, to allow you set up and manage a user account, to fulfill your order, to personalize your experience, and to analyze how you use our Services. Your Personal Information may be shared with third parties, but only in the capacity described below.
All individuals whose responsibilities include the Processing of Personal Information on behalf of Artkwaba are expected to protect that data by adherence to this Privacy Policy. This Privacy Policy is intended to meet requirements globally, including those in Europe, North America, APAC, and other jurisdictions.
PERSONAL INFORMATION WE COLLECT
The following section details the categories of Personal Information we have collected over the last twelve (12) months.
Information You Provide to Us
Artkwaba retains personal information that you share through the following types of interactions:
Placing an Order with Us. When you make a purchase or attempt to make a purchase through the Site, you provide certain types of information directly to us, including your name, billing address, shipping address, payment information (including credit card numbers and PayPal account information), email address, and phone number. We refer to this information as “Order Information”.
Creating an Account with Us. You have the option of creating an account with Artkwaba to allow easy access to your order history. During account creation, you provide your name and email address directly to us.
Communicating with Us. We may collect personal information such as phone number, email address or mailing address when you request information about Artkwaba, register for Artkwaba’s newsletter, request customer support, or otherwise communicate with us.
Completing Surveys. Occasionally, we may ask you to participate in online surveys about our products or services. If you decide to participate, you may be asked to provide certain personal information. All of this information is provided by you voluntarily, and may be used to improve our products, Site, or services.
Posting on the Site. You may add blog comments or post reviews of your purchases on Artkwaba’s site. When you disclose personal information through one of these submissions, it will be collected by the Site. If you choose to submit content to any public area of the Site, such content will be considered “public” and not subject to the privacy protections in this policy.
Registering for Sweepstakes or Contests. Occasionally, Artkwaba may run sweepstakes and contests. We ask those who enter in the sweepstakes or contests to provide contact information (e.g., an e-mail address). If you participate in a sweepstakes or contest, your contact information may be used to reach you about the sweepstakes or contest, and for other promotional, marketing and business purposes.
Information Collected Automatically or From Others
Automatic Data Collection. When you visit the Site, some information is automatically collected, including information about your web browser, IP address, time zone, and some of the cookies installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. This is used to personalize your site experience and to tailor content to you (on Arkwaba’s website and in advertising).
Cookies, Pixel Tags/Web Beacons, and Interest-Based Advertising. We, as well as third parties that provide content, advertising, or other functionality on the Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Services. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our Services.
Cookies. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly. If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Services that collects information about users’ engagement on that web page. The use of a pixel allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement.
Analytics We also use Google Analytics, Hotjar, and other service providers to collect information regarding visitor behavior and visitor demographics on our Services. You can opt out of Google’s collection and processing of data generated by your use of the Services by going to http://tools.google.com/dlpage/gaoptout.
Information from Other Sources
We may obtain information about you from other sources, including through third party services and organizations, to supplement information provided by you. For example, if you access our Services through a third-party application, such as a social networking site, we may collect information about you from that third-party application that you have made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your user name, location, gender, birth date, email, profile picture, and your contacts stored in that service. This supplemental information allows us to verify information that you have provided to us and to enhance our ability to provide you with information about our business, products, and Services.
HOW WE USE YOUR INFORMATION
We acquire, hold, use and process Personal Information to operate, improve, understand and personalize our Sites and our products. For example, we use Personal Information to :

We may share this information within Artkwaba and with Third Parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.

Categories of Third Parties with Whom We Share Information
We share Personal Data with vendors, third party service providers and agents who work on our behalf and provide us with services related to the purposes described in our Terms of Use. These parties include:

You may choose not to opt-in or disclose certain information to Artkwaba, but please note that some information may be needed to take advantage of some of the site’s features.
EU RESIDENT RIGHTS (GDPR)
For this section, we use the terms “Personal Data” and “processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure. Artkwaba will be the controller of your Personal Data processed in connection with the Site. Note that we may also process Personal Data of our customers’ end users or employees in connection with our provision of services to customers, in which case we are the processor of Personal Data. If we are the processor of your Personal Data (i.e., not the controller), please contact the controller party in the first instance to address your rights with respect to such data.
If there are any conflicts between this section and any other provision of this Privacy Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. OTHER PRIVACY RIGHTS
If you are a resident of a country outside EU, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at contact@artkwaba.com with the subject line “Outside EU Do Not Sell Request” and providing us with your name and the email address associated with your account.
How Long Do We Retain Your Personal Data?
We retain Personal Data about you as long as you have an open account with us and for as long as required after your close your account, in compliance with our legal obligations, to resolve disputes or collect fees owed, or as otherwise permitted or required by applicable law, rule or regulation.
What Security Measures Do We Use?
In proportion to the sensitivity of the information, we maintain reasonable administrative, technical, and/or physical safeguards and appropriate security measures to protect Personal Information from loss, misuse or unauthorized access, disclosure, alteration, or destruction of the information you provide. However, we cannot guarantee the security of your Personal Information, as no electronic data transmission or storage of information is completely secure. If an incident is reported affecting your information, we will investigate and comply with all required reporting obligations.
What Rights Do You Have Regarding Your Personal Data?
You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please fill out this request form. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.
Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data. You can also access certain of your Personal Data by emailing contact@artkwaba.com and we can email or mail you the requested information.
Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data by emailing contact@artkwaba.com.
Erasure: You can request that we erase some or all of your Personal Data from our systems. To do so, please email us at contact@artkwaba.com.
Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Site.
Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes.
Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
Right to File Complaint: You have the right to lodge a complaint about Artkwaba practices with respect to your Personal Data with the supervisory authority of your country or EU Member State.
DATA RETENTION
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Additional personal information obtained through the site will be trained for as long as you use our services or as necessary to fulfill the purpose(s) for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Changes to our Privacy Policy will be detailed here, and may also be emailed to you if you have subscribed to Artkwaba’s promotional emails. If you have not legally consented to receive email from Artkwaba, these Policies will still govern your use of our Services and you are responsible for understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.
CHILDREN’S PRIVACY
Our Services are not directed to children under 16 years of age, and Artkwaba does not knowingly collect Personally Identifiable Information from children under 16 years of age. If you learn that your child has provided us with Personal Information without your consent, you may alert us at contact@artkwaba.com. If we learn that we have collected any Personal Information from children under 16, we will promptly take steps to delete such information and terminate the child’s Account.
